Privacy policy
1. The security of user data is paramount
www.solapoint.ch respects the privacy of all users of the website or online shop (hereinafter referred to as „the customer“ or „customers“). These privacy policies form the basis for processing personal data and provide information on the types of user data collected by www.solapoint.ch, how www.solapoint.ch uses this data, and the rights granted to customers. www.solapoint.ch complies with applicable data protection laws and processes personal data solely for the purposes for which the data was provided.
These privacy policies may be adjusted, supplemented, or modified from time to time. Each new access or visit to the website is subject to the current and accessible version. In the event of any inconsistencies between this privacy policy and the applicable contractual or business terms of www.solapoint.ch, the provisions of this privacy policy shall prevail.
2. Nature and purpose of the data collected
The term „personal data“ as used in this privacy policy refers to information that can be used to personally identify customers. Processing of personal data includes any handling of such data, such as collecting, using, storing, disclosing, transmitting, or deleting the data. www.solapoint.ch automatically collects certain personal data when customers interact with the website or use the online shop. Additionally, personal data may be collected automatically or manually when a customer provides it (e.g., through contacting us, creating a user profile, or customer account).
2.1 When visiting the website of www.solapoint.ch, automatic collection of statistical visitor data occurs, which records the parts of the website visited by the customer. Each time a webpage is accessed, the web server automatically stores a server log file, which includes, for example, the name of the requested file, the customer's IP address, date and time of access, the browser used, operating system, data volume transmitted, and the requesting provider (access data), documenting the retrieval. In this context, it may be necessary for cookies (see section 4 below) to be used. These access data are exclusively evaluated for the purpose of ensuring smooth operation of the website and improving our services.
2.2 Data, during interaction with www.solapoint.ch, for contract processing, contacting and opening a customer account www.solapoint.ch does not automatically collect personal data of customers, such as the name, address, telephone number or e-mail address. However, personal data is collected from customers when they voluntarily provide it during the ordering process or when contacting www.solapoint.ch (e.g., through a contact form or email). Mandatory fields are marked as such because www.solapoint.ch requires this information for contract processing or to handle the contact request, and without providing the required data, the order or contact request cannot be submitted. The specific data collected can be found in the respective input forms.
If a customer decides to open a customer account, www.solapoint.ch will use the personal data for the purpose of account creation. The mandatory information requested during registration must be provided in full; otherwise, www.solapoint.ch may reject the registration. The collected personal data will only be used by www.solapoint.ch for the purpose of using the online shop or the specific offer or service for which the customer has registered. Additionally, www.solapoint.ch may use the customer's email address to inform them about important changes, such as changes in the scope of the offerings or necessary technical modifications.
After the complete processing of the contract or the deletion of the customer account, the customer's data will be restricted for further processing and deleted after the expiration of the statutory retention periods for tax and commercial purposes, unless the customer has expressly consented to further use of the data or www.solapoint.ch reserves the right to use the data beyond that, as permitted by law. The deletion of the customer account is possible at any time and can be done either by sending a message to the contact information provided below (see section 9 below) or through a designated function in the customer account.
3. Legal basis for collecting and processing personal data
The legal basis for the collection and processing of the client's personal data depends in each individual case on the purpose of the data processing. In particular, the following come into question:
- Safeguarding the legitimate interests of www.solapoint.ch, provided that the interests or fundamental rights and freedoms of the customer are not disproportionately affected.
- The conclusion or fulfilment of a contract.
- Consent of the customer at the time of collecting the personal data. The customer can revoke their consent at any time. For this purpose, the customer can send a corresponding notification to the contact information described below. The legality of data processing prior to the revocation remains unaffected.
4. Use of cookies and use of the data
4.1 To continuously improve the website for customers, www.solapoint.ch may use cookies. Cookies are small software information that is stored on the customer's computer hard drive by web browsers (such as Google Chrome, Internet Explorer, or Mozilla Firefox) to facilitate the use of the website (e.g., language selection, shopping cart, etc.).
Some of the cookies used by www.solapoint.ch are deleted after the end of the browser session, i.e., when the web browser is closed (so-called session cookies). Other cookies remain on the end device and allow www.solapoint.ch to recognize the customer's web browser on their next visit (so-called persistent cookies). The duration of storage can be found in the cookie settings of the web browser.
Most web browsers automatically accept cookies, but web browsers can be configured to decline or store cookies. However, disabling cookies may limit the functionality of the website. Details on how to manage cookie settings can be found in the user manual or help section of the web browser.
4.2 The anonymized data collected through cookies when accessing the www.solapoint.ch website may be used for web analytics purposes, website optimization, and performance measurement. www.solapoint.ch may employ third-party providers for these purposes, who may have their own privacy policies that www.solapoint.ch has no control over. www.solapoint.ch utilizes the functionalities of the following web analytics services:
Google Analytics: Provider: Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics is used by www.solapoint.ch to analyse website usage, compile reports on website activities, and provide further services related to website usage and internet usage. The IP address transmitted by the customer's web browser as part of Google Analytics is not merged with other data from Google. The information generated by cookies regarding the use of the website is usually transmitted to and stored on a server operated by Google in the USA. Google complies with the privacy regulations of the Swiss-U.S. Privacy Shield agreement and has registered under the Swiss-U.S. Privacy Shield with the U.S. Department of Commerce (for information on the Swiss-U.S. Privacy Shield, see https://www.privacyshield.gov/...-Shield-FAQs). For further information, please refer to Google's privacy policy at https://support.google.com/...swer/6004245… Google AdWords and Google Conversion Tracking: Provider: Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. www.solapoint.ch uses Google AdWords and the so-called conversion tracking. When a customer clicks on a Google ad, a cookie for conversion tracking is set. These cookies expire after a maximum of 30 days and are not used for personal identification. If the customer visits www.solapoint.ch's website and the cookie has not expired, Google and www.solapoint.ch can recognize that the customer clicked on the ad and was redirected to the respective page. www.solapoint.ch receives information from Google about the total number of users who clicked on the ad and were redirected to a website with a conversion tracking tag. However, www.solapoint.ch does not receive any information that personally identifies the customer. For more information, please refer to Google's privacy policy at https://www.google.de/...ies/privacy/.
Google Maps: Provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. www.solapoint.ch uses Google Maps to visually display geographical information. When using Google Maps, data about the usage of the Maps features by website visitors is transmitted to and processed by Google. This may include the IP address and location data. www.solapoint.ch has no control over this data processing. To the extent that information is transferred to servers of Google in the United States and stored there, the U.S. company Google LLC is certified under the Swiss-U.S. Privacy Shield.
To deactivate the service of Google Maps and prevent data transmission to Google, a customer needs to disable the JavaScript function in their web browser. In this case, Google Maps may not be usable or may have limited functionality. For more information, please refer to Google's privacy policy at https://www.google.com/.../terms_maps/.
4.3 Social Media Content: www.solapoint.ch may use social media plugins from social networks such as Facebook, Instagram, or Twitter on its website. When a customer visits a webpage that contains such a plugin, the web browser establishes a direct connection to the servers of the respective social network. The content of the plugin is transmitted directly from the respective provider to the web browser and integrated into the page. By integrating the plugins, the providers receive the information that the customer's web browser has accessed the corresponding webpage of www.solapoint.ch, even if the customer does not have a profile on the respective social network or is not currently logged in. This information (including the IP address) is transmitted directly from the customer's web browser to a server of the respective provider (possibly located in the USA) and stored there. If the customer is logged into one of the services, the providers of the social network can directly associate the visit to www.solapoint.ch's website with the customer's profile on that social network. If the customer interacts with the plugins, such as pressing the „Like“ or „Share“ button, the corresponding information is also directly transmitted to a server of the providers and stored there. The information is also published on the social network and displayed to the customer's contacts. These social network platforms have their own privacy policies that www.solapoint.ch has no control over.
The purpose and scope of data collection, as well as the further processing and use of data by the providers on their respective platforms, along with contact options and the relevant rights of customers, and privacy protection settings, can be found in the privacy policies of the providers:
- Facebook: https://www.facebook.com/policy.php
- Twitter: https://twitter.com/de/privacy
- Instagram: https://help.instagram.com/155833707900388
If the customer wishes to prevent the loading of any of these plugins, it is recommended to log out of the respective social network. Additionally, various web browsers can be configured or supplemented with add-ons (e.g., Facebook blockers) to prevent the loading of social media plugins.
5. Newsletter
If a customer wishes to subscribe to a newsletter offered by www.solapoint.ch, www.solapoint.ch requires the customer's email address and other information that allows verification that the customer is the owner of the provided email address and agrees to receive the newsletter (known as the „double-opt-in“ procedure). If the customer wants to subscribe to a newsletter as a registered customer, they can provide their consent at the time of registration or later through the subscription function in their customer account.
With the newsletter, the customer receives regular recommendations and offers that may be of interest to them. For this purpose, www.solapoint.ch collects and processes personal data regarding the customer's usage behaviour on the website, orders placed with www.solapoint.ch, and how the customer interacts with the newsletter (e.g., whether the newsletter is opened or which web URLs are clicked on). www.solapoint.ch may analyse this data for statistical purposes in order to better tailor the content of the newsletter to the customers' interests.
The processing of personal data entered in the newsletter registration form is based on the customer's consent, which can be revoked at any time for future use. The revocation can be made either through the „unsubscribe“ link in the newsletter, a written notification from the customer to www.solapoint.ch at the address provided below, or by unsubscribing in the customer account. The personal data collected is used by www.solapoint.ch for the content creation and sending of the newsletter. The data will not be disclosed to third parties for their own (advertising) purposes. www.solapoint.ch stores the personal data provided by the customer for the purpose of newsletter subscription until the customer unsubscribes from the newsletter.
6. Passing on your data
www.solapoint.ch will not disclose customers' personal data to third parties, except in cases where the customer has consented to the disclosure of data to non-affiliated companies or when www.solapoint.ch is legally, administratively, or judicially obligated to do so. Additionally, third-party service providers who assist www.solapoint.ch in data processing, website management, or in any other way, as well as in providing the products and services requested by the customer (e.g., package or newsletter delivery service providers), may be involved. These third parties are required to maintain the same level of security and data protection as www.solapoint.ch.
7. Data security
Unfortunately, the transmission of data over the internet is not completely secure. www.solapoint.ch works with service providers and internet providers who implement appropriate technical and organizational security measures to protect customers' personal data. However, www.solapoint.ch cannot guarantee the security of data transmitted by customers. Therefore, any data transmission is done at the customer's own risk.
8. Your information and revocation rights
Of course, every customer is free to inform www.solapoint.ch at any time, for example via email, that their personal data should not be used for future contact. Participation in special services provided by the www.solapoint.ch website, such as the newsletter service, can also be revoked at any time. Additionally, customers have the option to obtain information about the processing of their data or request a copy of the personal data collected through the www.solapoint.ch website.
