General Terms and Conditions (GTC) of Sola Switzerland AG E-Shop.
1. Scope of Application
The following General Terms and Conditions (GTC) in their currently accessible and valid version apply to the use of this website (www.solapoint.ch) as well as the business relationships between the operator of the website Sola Switzerland AG, Seetalstrasse 39, 6032 Emmen (hereinafter referred to as „Sola Switzerland AG E-Shop“) and the customers. The offer on this website is exclusively directed at customers residing in Switzerland. A customer is defined as any natural or legal person who maintains business relations with Sola Switzerland AG E-Shop. The GTC, delivery and payment conditions, as well as the privacy policy, may be subject to adjustments from time to time. Sola Switzerland AG E-Shop kindly requests that these provisions be carefully read during each visit to the website and when placing an order. These GTC exclusively apply. Contradictory, additional, or deviating conditions require the express written confirmation by Sola Switzerland AG E-Shop to be valid. By using this website or placing an order, the customer confirms the comprehensive acceptance of these GTC, including the delivery and payment conditions. If individual provisions of these GTC prove to be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The operator of this website is Sola Switzerland AG.

Sola Switzerland AG E-Shop provides information about products and services. Price and assortment changes, as well as technical modifications, are reserved. All information on www.solapoint.ch (product descriptions, images, videos, dimensions, weights, technical specifications, and other details) are to be understood as supplementary information and do not constitute a guarantee of properties or warranties unless explicitly stated otherwise. Sola Switzerland AG E-Shop strives to provide all information on this website correctly, completely, up-to-date, and in an organized manner. However, Sola Switzerland AG E-Shop cannot explicitly or implicitly guarantee the accuracy of the information. All offers on this website are non-binding and should not be considered as a binding offer. Sola Switzerland AG E-Shop cannot guarantee the availability of the listed products at the time of ordering. Therefore, all information regarding availability and delivery times is without guarantee and may change at any time without prior notice.
3. Prices
The price information provided by Sola Switzerland AG E-Shop includes, unless otherwise stated, the applicable value-added tax (VAT) and any applicable advance recycling fees (VRG). The prices in Sola Switzerland AG E-Shop are stated in Swiss Francs (CHF) and are net prices. Any applicable shipping costs will be charged additionally, unless otherwise specified, and are to be paid by the customer. Shipping costs will be indicated separately during the ordering process. Technical changes, errors, and misprints are reserved. In particular, Sola Switzerland AG E-Shop reserves the right to make price changes at any time without prior notice. Consultation and support services are not included in the sales prices. Unless otherwise stated in the price or product description, the shipping costs are CHF 9 per delivery for orders up to a value of CHF 99.00, regardless of the number of items ordered. Free shipping is provided for orders above CHF 99.00. No delivery costs will be charged for items to be picked up at Sola Point, Seetalstrasse 39 in Emmen.
The price may change due to a printing or other error regarding the price of the goods, as determined in the seller's system or published on the shopping portal for the goods. Both the buyer and the seller have the right to cancel the order or withdraw from the purchase agreement (until the goods are accepted) if the buyer is informed of a change in the purchase price of an item due to a printing or other error regarding the price of the goods.
4. Contract Conclusion
The offers on this website constitute a non-binding invitation for customers to order products and/or services from Sola Switzerland AG E-Shop. By placing an order through this website, including the acceptance of these terms and conditions, the customer submits a legally binding offer to enter into a contract. Sola Switzerland AG E-Shop then sends an automatic „order confirmation“ via email, confirming that the customer's offer has been received by Sola Switzerland AG E-Shop. Once an order is placed, it is binding for the customer. Unless otherwise specified, there is no right of return or withdrawal. The contract is concluded when Sola Switzerland AG E-Shop sends an acceptance declaration via email, confirming the shipment of the ordered products or services.
Orders will be shipped only after full payment has been received, provided that the goods are available. If it is determined after the conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full, Sola Switzerland AG E-Shop is entitled to withdraw from the entire contract or a part of the contract. If the customer's payment has already been received by Sola Switzerland AG E-Shop, the payment will be refunded to the customer. In the event of a contract dissolution, Sola Switzerland AG E-Shop is not obliged to make a replacement delivery.
5. Payment Options and Retention of Title
The customer is required to pay for the ordered goods. The following payment methods are available:
- Credit Card – Visa / MasterCard / Twint / PostFinance
- Advance Payment / Bank Transfer
- Payment upon pickup at Sola Point in Emmen
Sola Switzerland AG reserves the right to restrict the use of the mentioned payment methods for each order or to obligate the customer to use alternative payment methods. When paying by credit card, the order amount will be charged on the day of order placement. For credit card payments, the customer will be automatically redirected to our payment provider's website after completing the order on our Sola Switzerland E-Shop. The customer will enter their credit card details on a secure connection directly on our payment provider's website. No credit card information is stored in the Sola Switzerland E-Shop. If the customer chooses advance payment (bank transfer), Sola Switzerland AG will send an order confirmation by email, which includes the bank details and payment reference (order number), but no payment slip. A blank payment slip may be available at the post office or bank if needed. The payment deadline is 3 working days. If the customer does not make the payment within the specified 3-day period, Sola Switzerland AG may withdraw from the contract without further notice (Art. 109 OR). Sola Switzerland AG accepts payments exclusively in Swiss Francs (CHF) and only from Swiss bank or postal accounts, as well as Swiss credit card providers or credit card providers with Swiss authorization. Sola Switzerland AG does not assume any transaction fees under any circumstances. Refunds to customers are exclusively made to the account or credit card provider used for payment by the customer. A refund of amounts will only be granted if Sola Switzerland AG is found to have acted improperly. If the customer is no longer the holder of the mentioned account or is no longer a customer of the mentioned credit card provider, the customer is obliged to promptly notify Sola Switzerland AG of a new account with a Swiss bank or the postal service. Sola Switzerland AG may request a legally sufficient proof of ownership of this account from the customer or the mentioned bank. If this is not provided without further notice, Sola Switzerland AG may deduct all expenses for the refund from the refundable amount and charge the customer for any additional expenses. The working days mentioned in this clause exclude Saturdays, Sundays, and legal holidays at the registered office of Sola Switzerland AG, the registered office of the authorized courier, the corresponding post office, the forwarding and/or transport company, as well as at the customer's place of residence or business.
6. Delivery, Inspection Obligation, Defect Notice, and Returns
Deliveries will be sent by post or courier service to the address provided by the customer in the order. Invoices will be sent via email or by post. Upon shipment, the risk and ownership of the goods pass to the customer to the extent permitted by law. If the delivery is undeliverable, the customer refuses to accept the delivery, or the delivery is delayed for other reasons, Sola Switzerland AG E-Shop may terminate the contract after notifying the customer by email and setting a reasonable deadline, as well as charge the customer for any expenses incurred. The customer is obligated to inspect the delivered goods immediately upon receipt and promptly notify Sola Switzerland AG E-Shop in writing by letter to Sola Switzerland AG, E-Shop, Seetalstrasse 39, 6032 Emmen, or by email to info@solapoint.ch of any defects for which Sola Switzerland AG E-Shop provides warranty. Returns to Sola Switzerland AG E-Shop are made at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories, along with the delivery note and a detailed description of the defects, to the return address provided by Sola Switzerland AG E-Shop. If, upon examination by Sola Switzerland AG E-Shop, it is determined that the goods have no detectable defects or that they do not fall under the manufacturer's warranty, Sola Switzerland AG E-Shop may charge the customer for the expenses incurred, including the return or disposal of the goods. The third party, DHL, is responsible for the transportation.
7. Return of the goods against receipt of a voucher as a gesture of goodwill
According to legal regulations in Switzerland, there is no right of withdrawal when purchasing online. Nevertheless, the customer can return the goods within 14 calendar days of receiving the goods and receive a voucher number from Sola that can be redeemed once within 12 months by placing an online order.
The deadline is deemed to have been met if the customer sends the return of the goods to Sola Switzerland AG E-Shop by email to info@solapoint.ch or by letter to Sola Switzerland AG, E-Shop, Seetalstrasse 39, 6032 Emmen within the deadline.
The goods must be sent within 14 calendar days in their original packaging, complete with all accessories and together with the delivery note to the return address specified by Sola Switzerland AG E-Shop. Returns to Sola Switzerland AG E-Shop are made at the customer’s expense. After receiving the undamaged goods, the customer will receive a one-time voucher number as a gesture of goodwill, which must be stated before paying for the next online purchase. The customer is expressly advised that the amount of the voucher can be redeemed once and not in partial amounts. If the new order exceeds the amount of the voucher, the customer only pays the difference. The voucher must be redeemed by placing an online order within one year at the latest (the online voucher cannot be redeemed at the Point).
Sola Switzerland AG E-Shop reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice it to the customer.
8. Warranty
Sola Switzerland AG strives to deliver goods of impeccable quality. The warranty period is always two years from the date of delivery, and Sola Switzerland AG may fulfil the warranty by means of rectification, replacement, conversion, or reduction, at its discretion. The invoice receipt serves as the warranty certificate. If the manufacturer's warranty extends beyond the warranty provided by Sola Switzerland AG, Sola Switzerland AG also grants this extended warranty to the customer.
- Excluded from the warranty are:
- Parts that exhibit normal wear and tear due to the use of the product; these may be available for purchase as replacement parts upon request and at an additional cost.
- Parts that suffer damage due to poor or irregular maintenance of the product or as a result of heavy soiling.
- Damage caused by overexertion, such as excessive weight, heat, etc.
- Damage caused by mishandling, interference, or tampering.
- External circumstances such as elemental, moisture, impact, or shock damage, etc.
9. Liability
Liability is governed by the applicable legal provisions.
10. Data Protection
Sola Switzerland AG treats user data confidentially and in accordance with the principles of the Swiss Data Protection Act (DSG). Sola Switzerland AG uses user data within the Sola Switzerland AG, but only discloses user data to third parties if it is necessary to fulfil its obligations in connection with this website or if it is legally obligated to do so. Sola Switzerland AG implements appropriate security measures to prevent loss, misuse, or alteration of information and personal data. Depending on the sensitivity of the transmitted user information, Sola Switzerland AG automatically offers either unencrypted or encrypted communication through the website www.solapoint.ch.
11. Further provisions
Sola Switzerland AG E-Shop expressly reserves the right to modify these terms and conditions at any time and without prior notice. In the event of disputes, Swiss substantive law shall apply exclusively, excluding conflict of law’s provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded. The place of jurisdiction is Emmen, Canton of Lucerne, Switzerland, subject to other mandatory places of jurisdiction.
